By-law 99-07 Issuance of Fire Permits
THE CORPORATION OF THE TOWNSHIP OF GORDON
BY-LAW 99-07
Being a By-law for the Issuance of Fire Permits within the Municipal Boundaries of the Corporation of the Township of Gordon.
WHEREAS Section 210 (28) & (42) of the Municipal act, Chapter 30, R.S.O. 1980 provides for the establishment of regulations for preventing fires as the council considers necessary;
AND WHEREAS Council deem it necessary to establish fire restrictions and regulations with the Municipal Boundaries of the Township of Gordon.
NOW THEREFORE the Council of the Corporation of the Township of Gordon hereby enacts as follows;
1) DEFINITIONS
a) Fire Season: Period from January 1 to December 31 of each year.
b) Fire Permit Issuer: The Clerk/Treasurer of the Township of Gordon
is responsible for the issuance of Fire Permits.
c) Fire Permit: a legal document issued by a Fire Permit Issuer to the applicant
for the purpose of Burn Barrels, Grass Fires, Brush Fires & Controlled Fires.
d) Applicant: A person identified as the owner of residential property within the municipal boundaries of the Township of Gordon as indicated on the most recent assessment roll. An Applicant may give written authorization to a tenant of their property to make application for a Fire Permit.
e) Permittee: A person to whom a Fire Permit is issued.
2) GENERAL RULES
a) A Fire Permit will be required once per year for a Burn Barrel.
b) A Fire Permit will be required for each: Grass Fire, Brush Fire
and Controlled Fire .
3) ENFORCEMENT
a) Complaints which cannot be handled by the Clerk/Treasurer will be forwarded to the Fire Chief of the Gore Bay Volunteer Fire Department who will be required to investigate the merits of the complaint.
b) If a Permittee is in contravention of this by-law or by-law 98-03 the Fire Chief is required to make recommendation to the Clerk/Treasurer to revoke the permit.
c) Failure to comply with an Order would result in charges being laid pursuant to Part 1 of the Provincial Offences Act.
4) FEES
a) There will be NO FEE for the issuance of a Fire Permit unless the Fire Chief is required to investigate a complaint at which time Council may levy a fee for the Fire Permit.
b) Any persons could, at the recommendation of the Fire Chief be liable to a cost recovery by the Township of Gordon, if any regulation are broken with this by-law and by-law 98-03 and requires the attendance of the Fire Chief and/or Fire Department.
5) This by-law shall come into force and take effect on the final date of passing hereof.
