By-Law 98-03 Open Burning

THE CORPORATION OF THE TOWNSHIP OF GORDON


BY-LAW NO. 98-03


A by-law to prohibit open burning within the limits of the Township of Gordon.

WHEREAS Section 210 (28) & (42) of the Municipal act, Chapter 30, R.S.O. 1980 provides for the establishment of regulations for preventing fires;.

NOW THEREFORE, the Council of the Corporation of the Township of Gordon hereby enacts as follows;

1) No fires shall be set out of doors in the Township of Gordon between the hours of eight o’clock in the forenoon and six o’clock in the afternoon of each day of the week within the municipal protection area described as the limits of the Township of Gordon.

2) No person shall set any fire out of doors on the Township except in the presence of a competent responsible adult person and a competent responsible adult person shall be constantly in attendance upon and in charge of any burning operation to prevent same from spreading to or endangering property.

3) No person shall permit any fire set out of doors in the Township to spread to/or endanger property.

4) a) All outside fire shall be contained in a metal or masonry container, no greater than 45 gallons with a wire mesh top made of no larger than one-half inch wire mesh.
b) Notwithstanding the provisions of section (a) , burning of brush outside of open containers shall be permitted in rural and or undeveloped areas provided that,
(i) the pile of brush is no larger than six feet square and six feet high and
(ii) the brush is cleared from the property upon which it is being burned; and
(iii) the fire shall be minimum of fifty feet from any building or structure and a minimum of twenty five feet from any fence, brush and other combustible material and liquids; and

5) No out side fire which causes inconvenience or irritation to others shall be permitted.

6) No person shall leave the site of a fire set out of doors on the Township of Gordon without fully extinguishing the said fire,

7) Except as hereinbefore provided, no person shall set a fire of any kind out of doors in the Township of Gordon and no fire of any kind out-of-doors in the Township shall be allowed to burn during a Province Restricted Fire Band and during a high wind.


8) No person shall set a fire in a area where it may spread due to grass or other vegetation or a strong wind.


9) Nothing in this bylaw shall be deemed to authorize any fire, burning or other act which is in contravention of the Environment Protection Act, 1971, as amended, or any regulations made thereunder and in the event of any conflicts between the provisions of this bylaw and the said Act or Regulations, the provisions of the said Act or Regulations shall govern.

10) Any person who violates any of the provisions of this bylaw shall for every offence, incur a penalty of not more than one thousand dollars ($1,000) exclusive of costs and such penalty shall be recoverable under the provision of the Provincial Offences Act.

This bylaw shall come into force at the time of its passing by Council
